Avoid PAC VAN like the plague. There are too many other reputable companies from which to rent storage containers that can be moved. A good corporate citizen does not engage in games of 'I gotcha' when a customer complains about a service failure. An ethical corporate citizen apologizes and offers either a refund or a credit. Pac Van has done none of the above. The agreement between me and Pac Van was immediately terminated (within 24-hours) for fraud. Under Maryland law 'an aggrieved party may cancel a contract if there is a material breach that has not been cured or waived or the agreement allows cancellation for the breach. The party in breach of contract shall follow any reasonable instructions received from the other party.' The branch manager debited over $500 more than was authorized from my checking account, refused to refund the money, and then indicated that a loaded container cannot be moved, which was a 'material breach' of agreement recognized by Maryland law as a valid reason to terminate either an agreement or a contract. When I terminated the agreement, I demanded a full refund, which is all I am required to do under Maryland law to preserve all legal claims. Under the' reasonable person' doctrine, would any reasonable person rent a container, load it full of their personal property at great expense, and park the container in front of the house from which they are relocating (when there are other cheaper options available)? Pac Van's position is as implausible as it is indefensible.
